  • Landlord/Tenant

Landlord & Tenant Dispute Attorneys

Relationships between a landlord and tenant can often lead to disputes that need to be resolved through litigation. Common disputes include:

  • Landlord’s failure to return a security deposit
  • Landlord’s failure to maintain the property in a safe condition
  • Landlord’s failure to make necessary repairs
  • Wrongful eviction
  • Tenant’s failure to pay rent
  • Damage to the property by tenant
  • Eviction of tenants

The South Carolina Residential Landlord Tenant Act, S.C. Code Ann. § 27-40-10 to -940, provides guidance about how actions between landlords and tenants should be resolved. This legislation protects landlords and tenants by establishing a series of rights and duties for each party.

If a landlord or tenant violates the Act, then the winning party may be entitled to actual damages, treble damages (3 times the amount of the actual damages), reasonable attorney’s fees, and the right to cancel the rental agreement.  Additionally, a landlord may have the right to evict a tenant if a violation has occurred.

Jessica Means represents clients in residential landlord and tenant disputes. Whether it is a dispute about a lease, failure to return a security deposit, failure to make repairs, or an eviction, she can help.
