The South Carolina Residential Landlord Tenant Act, S.C. Code Ann. § 27-40-10 to -940, provides guidance about how actions between landlords and tenants should be resolved. This legislation protects landlords and tenants by establishing a series of rights and duties for each party.
If a landlord or tenant violates the Act, then the winning party may be entitled to actual damages, treble damages (3 times the amount of the actual damages), reasonable attorney’s fees, and the right to cancel the rental agreement. Additionally, a landlord may have the right to evict a tenant if a violation has occurred.
